Freelancer Agreement
Official legal agreement for all freelancers working with Malice Studios.
By working as a freelancer at Malice Studios, you are considered to have read, acknowledged, and accepted all the terms outlined below. Additionally, by accepting any commissions, you agree to be bound by all the terms and conditions specified herein as well as have read our terms of service.
I commit to maintaining the highest level of professionalism and respect to ensure that the client has a positive and enjoyable customer experience with Malice Studios.
I will refrain from disclosing any sensitive or private information, including but not limited to the client's ideas, data, and details shared in tickets or commissions.
I commit to refraining from any abuse or exploitation of the Malice Studios Discord bot (Commissions System).
I agree to confine all discussions to the tickets within the server. There should be no direct contact with the client outside of the Malice Studios Discord server. In the event that a client contacts me privately through Malice Studios, I will redirect them to the main server.
I acknowledge and agree that I may be removed and replaced from a ticket at any time if deemed necessary by management, and I may not be entitled to compensation for the work already completed if you’re inactive in the commission and/or if you give a poor quality product to the client.
I agree not to receive any payments directly to my PayPal or any other payment agency. I will exclusively go through the payment process facilitated by the Malice Studios Discord bot.
I agree that I will genuinely intend to provide services to Malice Studios and commit to refraining from any attempts to scam the team or clients.
I agree that my work may be used or showcased on any or all of the Malice Studios platforms.
I agree that these terms are subject to change without notice.
I agree that if I depart from a commission during the project's execution, I may not receive compensation for the services rendered, and the payment may be allocated to the new freelancer taking over. This condition applies even if a client expresses dissatisfaction with the current freelancer.
I acknowledge and take responsibility for the fact that when receiving payments from PayPal or any other payment method, there are associated fees that will not be covered by Malice Studios.
Additionally, I acknowledge that all payments are sent through Goods and Services and not Friends and Family.
By default, all of the withdraw requests are accepted in PayPal. If you'd want to use another payment method, then you can make a support ticket in the Discord server before you make the withdraw request for it.
I agree that if a ticket is not completed by the deadline, the client reserves the right to request a refund if they find it necessary.
I acknowledge that in the event of a refund for a ticket or commission, the amount I receive will be reduced.
I agree to provide a one-week period for 5 free revisions of the product. Following this period, additional revisions may be subject to charges.
Note: Revisions and updates are two separate things.
I agree to exert my best effort and adhere to Malice Studios's standards of providing high-quality services.
I agree to maintain the confidentiality of all information posted in channels designated for freelancers, management, or any similar non-public forums.
I agree to provide a minimum of a 2-day notice before leaving the team.
I agree that I cannot attain a role higher than "Freelancer" if I already hold a higher position in another service team.
I agree not to engage in direct communication with freelancers, clients, or any other parties outside of Malice Studios for any purpose.
Malice Studios will have access to my preferred payment method, which is necessary for sending payments for completed tickets. Please be aware that our Discord bot will also have access to your preferred payment method for withdrawal requests.
I agree that any typos or errors in my preferred payment method, as provided to Malice Studios, could lead to the payment being sent to someone else, resulting in non-payment from Malice Studios. In such cases, Malice Studios will not be held responsible or liable.
I agree that the price of invoices will include a handling fee of 10%. For example if the ticket price is $15, the total invoice will be $16.50. I understand that I will only be paid the original ticket price of $15 before the handling fee and any commission rates are applied. My overall payment as a freelancer, after deducting the handling fee and commission rate of 85.5% will be $12.82, not including any PayPal fees for goods and services. I understand I will receive 100% of any and all of a tip given by a client for my work. I understand tips can be sent directly to my PayPal email on a case by case basis and if agreed by all of the parties which are involved and if they aren’t and if they’re handled in an invoice, then the payment amount, as said above, will apply.
I agree and understand that I may not receive pay for a commission that I completed if I leave the Discord Server before the withdraw request is sent.
I agree that upon accepting a ticket, I will refrain from commencing any work until the payment for the ticket has been confirmed by management. This includes waiting for updates or notifications regarding invoice payments received through the bot.
I agree that Malice Studios reserves the right to remove me from any ongoing commission at any given time, without providing compensation if you’re inactive in the commission and/or if you give a poor quality product to the client.
As a freelancer, I agree that the work I have produced was not stolen, and it was created and is owned by me.
I agree that if I initiate work before an invoice is paid, there is a possibility that I may not be compensated, as there is a risk that the client may not fulfill the payment for the invoice. There is nothing Malice Studios can do for you if this happens. You as the freelancer assume all risk in this situation.
I agree that if I produce a product that falls below the client's expectations and is deemed sub-par, the client may opt for a refund only if the final product deviates from the original commission description and receives approval from the executive team. No compensation will be provided to the freelancer in such cases.
I agree that the portfolio link I provide belongs to me, and all the work showcased in that portfolio is created by me. I also affirm that any link included in my portfolio is non-malicious.
I agree that I have a genuine intention to provide services to clients.
I agree that Malice Studios is not liable for any loss in payment, including but not limited to instances where clients initiate chargebacks.
If you are mid commission and it hasn't been marked complete yet by the bot, if and when the client chargebacks, Malice Studios will not be liable for loss of funds. Malice Studios will still fight the dispute, there are detailed records of logs and ticket transcripts to support the case. In the rare instance Malice Studios does lose the dispute, this is when the freelancer would not receive payment.
If a commission has already been marked complete and funds have been transferred to the freelancer's wallet and/or been withdrawn, Malice Studios will be responsible for any chargebacks.
I agree that if I exit the Malice Studios Discord Server and do not return within 30 consecutive days, any remaining balance in the Discord Bot's Wallet will no longer be accessible, and no compensation will be provided.
I agree that by having anyone claim on my behalf, I release and forever discharge Malice Studios and its affiliates, successors, officers, employees, representatives, partners, agents, and anyone claiming through them (collectively, “Malice Studios”), in both their individual and corporate capacities, from any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes of action of any nature and kind, known or unknown, which Malice Studios has had, currently has, or may have in the future against me.
This release shall be binding upon the parties and their respective heirs, administrators, personal representatives, executors, successors, and assigns.
Behavior Standards
Toxicity
Malice Studios maintains a commitment to fostering a professional and friendly environment. Any display of toxic behavior will not be tolerated and may result in strikes or termination.
Giving Low-Quality Services
Malice Studios endeavors to deliver the best services as outlined in our thread designs. Failure to meet these standards may lead to strikes or termination.
Failure to maintain professionalism
Malice Studios places a high value on having a professional team. Falling short of this standard may result in strikes or termination.
Low-Quality Customer Support/Experience
Malice Studios is committed to ensuring our clients/customers have a positive experience. Inadequate attention to this aspect may lead to strikes or termination.
Using Works of Others
Malice Studios strictly prohibits freelancers from using other people's work without permission. This involves any and all use of artificial intelligence. Any attempts to do so will result in immediate termination.
Payments
All payments from commissions/tickets must be received from our business email first before being sent to the Freelancer. Any attempts to circumvent this process will result in termination. All payments from commissions/tickets are deposited into the freelancer’s wallet when the commission has been marked as complete.
Activity
While we recognize that freelancers may experience busy periods, any prolonged inactivity without prior notice may lead to strikes or termination.
Inappropriate Material
Any engagement in behavior considered inappropriate, including but not limited to illicit material, illegal content, extortion, fraud, and misappropriation, is not tolerated.
Strikes
In the event of receiving a strike, a comprehensive review will be conducted, documented, and may involve meetings with you.
Termination
If you are terminated from working as a freelancer at Malice Studios, you will no longer have the opportunity to work for Malice Studios or apply for any role in the future.
A Director has the authority to issue a strike to a Freelancer based on any of the situations outlined above. Additionally, strikes or warnings may be applied for other unlisted situations.
Freelancers are subject to a 3-strike policy. Upon accumulating three strikes, termination will ensue, resulting in a ban from further applications.
Strikes For:
- • Client being refunded for Unsatisfactory/Substandard Products
- • Being toxic and unprofessional
- • Contacting clients through DMs
- • Leaving an active commission
Warnings For:
- • Not updating a ticket within 48 hours
- • Missing deadlines
- • Quoting low and increasing later
